TERMS OF SERVICE

I. GENERAL

-Please read Prices and Terms of Services carefully.
-By commissioning the artist (ycearts), the client agrees to these terms.
-The artist (ycearts) reserves the right to decline any commission request that do not fit my capabilities.

II. PROCESS

-The Client may inquire through my socials, but commission requests will be via "send request here" forms.
-The artist (ycearts) will review the request and will send you the project scope including the price, queue, and payment details.

III. PAYMENT

-Payment will be upfront for 300 USD and below.

*Pre-bookings/Reservations:

-Deposit of 100 USD or 30% of the final price, whichever is higher.
-Remaining balance before starting sketch or
- 50% before sketch and line art phase; 20% (full payment) before coloring phase.

IV. PAYMENT PLANS

-Available for commission requests over 300 USD.

*Half-Half

- 50% Deposit: Before starting commission (Sketch / Line art phase)
- 50% Full Payment: Before coloring and rendering phase.

*OTHER PAYMENT PLANS

-You may also propose a payment plan; however it will be subject to my agreement.
-Note that payment should be made before any work is done.

V. REFUNDS

-Refunds are not accepted if the client cancels. Please confirm your commission purchase carefully.
-if the artist (ycearts) cancels, the client will be refunded to the amount received by the artist minus terminal fees.

VI. DEADLINES & DELVERY

-Art commissions may take up to 3 to 8 weeks for the final illustration upon identified start date.
-Timeline is subject to change depending on the queue, complexity of the request, and/or communications delay.
-Should there be any delays due to personal matters—work, health, etc., client will be informed with a new suitable timeline.*Note that I do not work on art commissions on Sundays.

VII. REVISIONS

-2 round of revisions are free during the rough sketch & line art phases.
-Any additional minor revision after the base color phrase will incur a fee of 20 USD per revision.
-The Artist (ycearts) reserves the right to propose alternative solutions and make minor changes after line art and base colors are completed.
-The Client will be informed if certain changes are not feasible.
-Additional significant revisions may extend the project timeline.*The artist (ycearts) have the right to terminate the commission contract, without refunds, should the client fail to communicate 30 days from the last message/update sent by the artist.

VIII. COMMUNICATION

-The Artist (ycearts) will update the client through out the process: Rough sketch phase, Line Art phase, Base Color phase, and Final Piece.
-The Artist (ycearts) will update for milestones and any alterations, during the process. Feel free to ask for updates anytime in between.

VIII. CONFIDENTIALITY

-If NDA fee is paid, the Artist (ycearts) will maintain confidentiality regarding the project, including:a) Keeping all project materials and information about the book and its characters strictly confidential.
b) Refraining from showcasing work-in-progress and finished Artwork on their portfolio or social media until the Client has shared it on their social media, or 12 months have passed since project completion.

IX. ARTIST'S RIGHTS & responsibility

-The Artist (ycearts) retains the copyright to the Artwork & reserves the right to:a) Showcase the Artwork in their portfolio.
b) Display the Artwork on their website and social media platforms.-The Artist (ycearts) acknowledges that the intellectual property rights to the characters belong to the Client.
-The Artist's compensation for the project is limited to the agreed-upon project fee, and they will not receive any additional financial benefits from the commercialization of the artwork.-For printed products: Include the credit on the product or on a separate accompanying card:

X. NO AI

Both parties agree to employ their best efforts to avoid AI usage:-The Client agrees not to use the Artwork, in whole or in part, as training data or input for any generative AI model without the Artist's explicit written consent. The Client further agrees not to utilize generative AI in conjunction with the Artwork for marketing purposes. Any breach of this clause will result in immediate termination of the license, without refund.
-The Artist (ycearts) warrants that the Artwork is original and that no generative AI was used in the development of references, sketches, or the final product. The Artist will make every effort to avoid using generative AI whenever possible in relation to the project.
-Upon request, with a minimal fee of 30 USD, the Artist will provide proof of original creation, demonstrating expertise in the chosen medium through explanation of the process or evidence of skills.
-If and when client is proven to be using generative AI, contract will be terminated and/or License will be canceled with no refunds.

XI. MORALITY CLAUSE

Both parties agree that their conduct will not negatively impact the other reputation, brand or public image:-The Client agrees that the granted usage rights are contingent on the understanding that the Artwork will not be used for generative AI, or for any content that is sexist, homophobic, transphobic, racist, or otherwise harmful. Usage in violation of this clause will result in termination of the license.-The Artist (ycearts) affirms that their artwork is created with the intention of promoting positivity and respect, and not for use in connection with sexist, homophobic, transphobic, racist, or otherwise harmful content.
